There are conflicting reports about Burton's outrage and what happened on the plane. CBS News reported the conclusion of the US Attorney's office that criminal charges would not be filed because the death was not intended. Time contains an article by Timothy Roche entitled "Murder in the Sky" where they describe a commotion that rose after Burton was initially conquered. According to the article, eight people who pinned Burton up after Burton wounded an officer who was not on duty in his fight and removed the people who held him. Time reported that fellow passenger Dean Harvey said that one of the people involved kept jumping on Burton's chest even after he was told that Burton was under siege.
In the case of air rage, Burton accused the cockpit door, kicked it open and tilted his head. Eight passengers held him, some held him with their feet around his neck, causing him to suffocate.
The medical examiner's autopsy report stated that when the police arrived, "Mr. Burton was lying face down with at least one person standing at his neck."
